(hereinafter WPS) maintains this web site for entities within the travel industry such as hotels, travel agencies, help desks of Travel booking and reservation solution companies (hereinafter USERS) to inform and be informed about the status and payments of commissions of bookings provided by Travel booking and reservation solution companies (hereinafter BOOKING DATA PROVIDERS or just BDP) as part of the service Worldwide Commission Management System (hereinafter WCMS).

By accessing and using this site, the USER agrees to abide by and accept the terms and conditions detailed below which include the following disclaimer, copyright notice and WPS policy on protection of personal data. WPS reserves the right to make changes or amendments from time to time to the scope of this web notice that conforms to any legislative or other legal changes which may arise or to industry practices and developments in information technology, depending on the requirements of the service and the protection of the BDP and USERS If any such changes are made, WPS will announce the changes on this site with sufficient notice to enable the USERS to be properly conversant with them, whereupon they will come into force and be applied immediately.

The contents (excluding booking and commission data), graphics, forms, indices and other formal expressions which are included on this web site, together with the computer programs on which the operation of the site is based and the actual visual form of the web pages, are owned by WPS (save for all that may correspond to the BDPs’ Visual Identity, which is made up of all the graphical elements of the BDPs’ corporate identity, that includes: the corporate logotype and tagline). As a result, these are works which have the protection afforded by the applicable international conventions and treaties and by domestic legislation. Any violation of these rights may be dealt with in accordance with the applicable civil and criminal legislation.

Any form of copying or reproduction of this web site and the software referred to above is totally prohibited, save with the prior written authorization of the owner of the intellectual property rights and without prejudice to any exceptions which may be laid down in the applicable legislation or rules.

It is particularly forbidden to engage in any act by which the USERS of the web site - or other people, regardless of the means by which they have obtained access to it - are able to exploit or make commercial use of the contents, graphics, indices and forms which form part of the site. By way of example and without limitation, it is forbidden to reproduce, distribute, exhibit, transmit, store in any physical, logical or optical form, digitalize or make available to third parties the aforementioned contents, expressions, graphics, indices or forms, or the computer programs which sustain the operation and visualization of this site.

BDP and USERS providing information are responsible for the information provided or modified by them and posted on this site and WPS is not liable for the truth or accuracy of this information.

WPS assumes no liability for errors or omissions in the information provided (either electronically or manually) by BDPs or USERS. WPS does not warrant the content of the information posted in this web site and under no circumstances will it be held liable for any loss which might be caused as a result of the aforementioned activities

It should be noted that in addition to WPS’ role of maintaining this web site there are cases where WPS also acts as a third party provider to some hotels and supplies commission data on behalf of these hotels whom have contracted the WPS commission processing services. As per the commission data WPS provides on behalf of its hotel clients, it is these hotels that are responsible for the information posted on this site and WPS is not liable for the truth or accuracy of this information.

WPS assumes no liability for any technical or typographical errors which may occur on this web site, provided that they are not due to any negligent activity.

2. The USERS agree to release WPS from all liability in respect of the information posted.

3. WPS shall provide the service with the highest diligence and according with the best existing practices in the market, however WPS does not guarantee that its web site will not suffer from interruptions or that it is free from errors. WPS will use every possible effort to correct any interruptions or errors on the basis of the state of the technology at the relevant point in time.

4. Whilst WPS will use all the reasonable technical means available to ensure that information and technology used to support this service can be transmitted and exchanged without infection, it will not be liable for any virus infections or any other code or defect which might contaminate or cause damage to the terminals or property of the USERS. Each USER is responsible for adding its own forms of guarantees and protection in addition to those provided by WPS, in order to meet or guarantee his or her particular requirements.

WPS' policy on the protection of personal data is subject to Organic Law 15/1999 of 13th December 1999 on the Protection of Data of a Personal Nature (Ley Orgánica de Protección de Datos de Carácter Personal) (BOE [Official Gazette] 14.12.1999) which in turn is a restatement of the European Community law, together within its implementing and supplementary legislation. The standards of protection for personal data under this legislation are of the highest order. For its part however, WPS takes the view that these legal levels of protection, high as they may, are only a minimum and that a greater degree of protection can be provided. This will be voluntarily provided by WPS as part of its own policy for protecting the right to privacy as the distinguishing feature of a better service for the USERS.

By this notice WPS informs the USERS of the web site about its policy for the protection of personal data (hereinafter "the personal data") so that USERS are free to decide whether they wish to provide WPS with any personal data which they may be asked for, or which may be necessary in order to carry out WPS services such as WCMS or which may be obtained from the USERS through subscription, registration, support purposes or simply by using the WCMS.

2. Certain services provided by WPS may contain particular conditions with specific provisions relating to the protection of personal data. These specific provisions will be clearly addressed where correspond.

3. Although you can browse through most of this site without giving any information about yourself, in some cases, personal information is required in order to provide WPS services. Such data should be limited to minimal personal and identifiable data about yourself (e.g. name, title, address, telephone number, and e-mail address). Any personal data obtained corresponding to the USERS will be added to electronic records owned by WPS and WPS is the controller of this data. With this end in mind WPS will enable USERS to access this notice about the company's data protection policy or any other relevant information so that they can give their consent to WPS for processing their personal data in this way.

4. The only reasons for the collection and treatment of personal data is to ensure that the WCMS service provided is adequate, to enable the exchange of necessary information between USERS, to facilitate the handling, administration, provision, expansion and improvement of the service provided to the USERS or to ensure that this service meets the preferences and requirements of the USERS, to study how the service is used by the USERS, to design new services related to the existing services and to inform about them, to provide all WPS services and contact USERS when needed within these services, to provide the USERS’ contact data to other companies in the name and on behalf of the USERS when necessary to complete the WCMS Service and other WPS services and to inform about WPS’ services.

5. WPS has met the legally required levels of security for the protection of personal data and has installed all the technical measures with the diligence that the current state of the technology permits, in order to avoid the loss, improper use, alteration, unauthorized accessing and theft of personal data provided to it. However, the USER must be aware firstly that Internet security measures are not impregnable and secondly that they themselves must maintain the required levels of diligence in terms of their responsibility for looking after their own information and login access and their responsibility for the information obtained as a result of or through the service provided by WPS.

6. The USERS are the only ones responsible of any damage or prejudice, direct or indirect, that may be caused to WPS or any third person/company as a consequence of providing any personal data that is false, inexact, incomplete, not updated or corresponding to third persons.

7. For security and crime prevention reasons WPS may record some of the information arising in the course of the activities and service which it provides through this web site for a limited period of time. However, in the interests of protecting the right to privacy WPS will not check or monitor the information posted and it will not therefore be liable if any of the contents of the aforementioned activities should turn out to be criminal or unlawful. In the event that it becomes aware, either itself or through a USER, of the criminal or unlawful contents of any information, WPS will remove it immediately, without prejudice to any legal actions which might follow or arise. For these purposes WPS is acting solely as a distributor of information.

8. WPS will not provide the USERS’ personal data to third parties or to any other company whether or not it is located within the European Community or abroad except when necessary to complete the WCMS service and other WPS’ services in the name and on behalf of the USERS.

9. USERS have the rights to which they are entitled pursuant to the legislation referred to above and they may exercise their rights of access, cancellation, rectification and objection. To do so they should send a written notice with the reference “Data Protection” to WPS: C/ Torneo nº 72, Sevilla 41002, Spain. They also have the right to be informed of any change in the policy on the protection of personal data.

10. In cases where the USERS or the BDPs provide third-parties’ personal data related to the bookings, such as name and surname of a guest, for being processed within the WCMS (which includes the display of the status of the commissions and claiming functions), WPS shall act in the name of these entities, USERS and BDPs, and shall meet the following requirements:
